5. User Content

Be solely responsible for the content of your broadcasts

8.2 Viewer Conduct

Stream viewers must:

Respect streamers and other viewers
Not harass, threaten, or abuse streamers
Comply with streamer-set rules and our policies

8.3 Recording and Storage

Streams may be recorded and stored for moderation, safety, and compliance purposes. Unauthorized recording or redistribution of streams by users is prohibited.

9. Intellectual Property

The Service, including its design, features, content, trademarks, and technology, is owned by us or our licensors and is protected by intellectual property laws. You may not:

That you will find matches, connections, or relationships
The accuracy, reliability, or completeness of user profiles
The conduct, identity, or intentions of other users
Uninterrupted, secure, or error-free operation of the Service

12.3 User Interactions

You are solely responsible for your interactions with other users. We are not responsible for the conduct of any user on or off the Service. Exercise caution and good judgment in all interactions.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER

THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless Des.irable.com, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your User Content
Your violation of these Terms
Your violation of any rights of another party
Your violation of applicable laws

15. Dispute Resolution

15.1 Informal Resolution

Before initiating formal dispute proceedings, you agree to first contact us at des@irable.com to attempt to resolve any dispute informally. We will attempt to resolve disputes within 30 days.

15.2 Arbitration Agreement

If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

15.3 Class Action Waiver

YOU AND DES.IRABLE.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15.4 Exceptions

This arbitration agreement does not preclude:

Claims in small claims court
Seeking injunctive or equitable relief in court for intellectual property infringement

15.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms to des@irable.com.

16. Termination

16.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Upon termination:

Your access to the Service will be revoked
Your profile will be removed from the Service
Certain information may be retained as required by law or for legitimate business purposes

16.2 Termination by Us

We may suspend or terminate your account at any time for any reason, including:

Violation of these Terms
Conduct that we believe is harmful to other users or the Service
Extended inactivity
Legal or regulatory requirements

16.3 Effect of Termination

Upon termination:

All licenses granted to you under these Terms will immediately cease
You must immediately stop using the Service
Sections of these Terms that by their nature should survive termination will survive

17. Geographic Restrictions

The Service is intended for use globally but may not be available in all jurisdictions. You are responsible for compliance with local laws in your jurisdiction. We make no representation that the Service is appropriate or available for use in any particular location.

These Terms shall be governed by and construed in accordance with the laws of Texas, USA, without regard to its conflict of law principles.

19.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, pandemics, government actions, or technical failures.
